FANCL Group Human Rights Policy

Based on our corporate philosophy of “Eliminating the ‘negatives’ with a sense of justice,” in 2018 we formulated our “FANCL Group Sustainable Declaration: Building a Bright Future Together” to express our will to face uncertainties in the future, such as environmental and social problems, and together with our stakeholders create a sense of hope for the realization of a sustainable society for people today and into the future.

Respect for human rights is the foundation of all our business activities. To fulfill and promote our responsibility of respecting the human rights of everyone involved in our business, we have established the FANCL Group Human Rights Policy (our “Policy”) as a guideline for the overall Group. Our Policy takes precedent over all documents and norms regarding efforts to respect human rights in the FANCL Group's business activities.

1. FANCL’s basic approach to human rights

FANCL Group recognizes the importance of respect for human rights in all activities.
FANCL Group respects human rights as stipulated in the International Bill of Human Rights*1 and the International Labor Organization's (ILO) Declaration on Fundamental Principles and Rights at Work*2. We also support the UN Guiding Principles on Business and Human Rights*3 and are working towards putting them into practice. In addition, FANCL Group is a signatory to the United Nations Global Compact.

  1. The International Bill of Human Rights is made up of three documents: the Universal Declaration of Human Rights; the International Covenant on Civil and Political Rights; and the International Covenant on Economic, Social and Cultural Rights. At present, the International Bill of Human Rights is considered to be the basic framework for internationally recognized human rights protection.
  2. The ILO Declaration on Fundamental Principles and Rights at Work sets the following principles to be the minimum standard to be observed in labor practices: (1) freedom of association and the effective recognition of the right to collective bargaining; (2) the elimination of all forms of forced or compulsory labor; (3) the effective abolition of child labor; and (4) the elimination of discrimination in respect of employment and occupation.
  3. The UN Guiding Principles on Business and Human Rights was approved by the United Nations Human Rights Council in 2011. It is an authoritative international standard that requires governments and businesses to prevent and address the risks of negative human rights impacts of business activities.

2. Scope of application:

This policy applies to all officers and employees of FANCL Group. FANCL Group will endeavor to have all business partners involved with our products and services understand this policy and will request compliance with it.

3. Fulfilling obligations to respect human rights

FANCL Group will not deliberately infringe on human rights. If we find that any of our business activities are having a negative impact on human rights, we will fulfill our responsibility to respect human rights by taking appropriate measures to correct the situation.

4. Implementation of human rights due diligence

FANCL Group has established a system to enable human rights due diligence, and identifies the negative impact of FANCL Group on human rights in society, and works to mitigate and prevent this.

5. Dialogue and discussion

In the process of implementing this Policy, FANCL Group will utilize independent outside human rights expertise and engage in dialogue and discussions with stakeholders in good faith.

6. Education and training

FANCL Group provides a wide range of human rights awareness, education and ability development training to all officers and employees so that our Policy is incorporated into all of their business activities and implemented effectively.

7. Remedies

If it becomes clear that FANCL Group's business activities have negatively impacted human rights, or if this impact has occurred through our involvement with our business partners and other parties, we will work diligently to seek a remedy through dialogue and appropriate procedures.

8. People who are responsible

FANCL Group will clarify the officers responsible for implementing our Policy. These officers will supervise the implementation and monitor its status.

9. Information disclosure

FANCL Group will disclose the progress of its efforts to respect human rights and the results on its corporate website.

10. Applicable laws

FANCL Group complies with the laws and regulations of each country where it conducts business. In the unlikely event that the laws and regulations of that country differ from international human rights norms, in the event of a conflict, we will follow a higher moral standard and seek ways to maximize the respect for internationally recognized human rights.
